Welcome to Simplycake Bakery! These Terms & Conditions (“Terms”) govern your use of our website, online ordering system, SMS communications, and any related services. By using our site or services, you agree to these Terms. If you do not agree, please stop using our site.
1. Use of Our Website
You agree to use our website for lawful purposes only.
You may not:
• Interfere with the operation of the site
• Attempt to access systems or data without permission

We may restrict access or terminate use if these rules are violated.
2. Online Ordering & Payments
When placing an order, you agree that all information provided is accurate.
• Payment is due at the time of ordering (unless otherwise stated).

• Custom cake orders may require confirmation or deposits.
We may cancel or refuse orders for reasons such as availability, errors, or suspected fraud.
3. Refunds, Cancellations & Order Changes
Standard Orders
• Cancellations must be made at least 48 hours before pickup.
• Refunds may not be available for late cancellations.
Custom Cakes / Specialty Orders
• Design changes must be submitted at least 72 hours before pickup.
• Custom cake deposits are non-refundable.
Quality Concerns
If something is wrong with your order, contact us within 24 hours so we can review and determine the best resolution.
4. Allergies & Food Safety
Our products are made in a facility that uses milk, eggs, wheat, soy, peanuts, and tree nuts.
We cannot guarantee any item is allergen-free.
Please inform guests of potential allergens.
5. SMS Terms of Service
By opting in to receive SMS messages from Simplycake Bakery, you agree to:
• Message types: order updates, pickup reminders, announcements, promotions
• Opt-in is done through an optional checkbox on our website
• Reply STOP to unsubscribe
• Reply HELP or call (650) 348-2888 for support
• Message and data rates may apply
• Message frequency may vary
• Your SMS consent and phone number will not be shared with any third party or affiliate
SMS usage is also governed by our Privacy Policy.
6. Intellectual Property
All content on our website—including photos, logos, descriptions, and designs—is the property of Simplycake Bakery.
You may not copy or use our content without written permission.
7. Limitation of Liability
To the fullest extent permitted by law:
• We are not liable for indirect or consequential damages.
• Our total liability for any claim will not exceed the amount you paid for your order.
• We are not responsible for delays or issues caused by circumstances outside our control.

11. Gift Card Terms & Conditions
Effective Date: 2/8/2025
These Gift Card Terms & Conditions apply to all gift cards purchased from Simplycake Bakery.
11.1 General Terms
By purchasing or using a Simplycake gift card, you agree to these terms. Gift cards are issued by Simplycake and are redeemable only at Simplycake Bakery locations.
11.2 No Expiration & No Fees
Our gift cards do not expire and are not subject to service fees, dormancy fees, or maintenance fees.
11.3 Redemption
Gift cards may be redeemed for food, beverages, merchandise, or services at SimplyCake Bakery.
They cannot be used to purchase other gift cards.
Gift cards may not be valid for online purchases unless explicitly stated at the time of sale.
11.4 Purchase & Reloading
Gift cards can be purchased in-store at any Simplycake location in any amount over $10.
Cards may be reloaded at any time with no minimum.
Accepted payment methods include cash, debit, and credit card.
11.5 Cash Redemption (California Requirement)
In accordance with California law, any gift card with a remaining balance of less than $10 is redeemable for cash upon request.
11.6 Lost, Stolen, or Damaged Cards
Gift cards should be treated like cash.
Simplycake is not responsible for lost, stolen, damaged, or unauthorized use of gift cards.
Gift cards will not be replaced or refunded.
11.7 Purchases Exceeding Gift Card Balance
If the purchase total exceeds the gift card balance, the remaining amount must be paid with another accepted payment method.
11.8 Limitation of Liability
Simplycake is not responsible for unauthorized use or alteration of a gift card.
Our liability is limited to the remaining balance on the card.
11.9 Fraud Prevention
We reserve the right to refuse, cancel, deactivate, or review any gift card suspected of fraud, misuse, or incorrect issuance.
11.10 Changes to Gift Card Terms
Simplycake may update these Gift Card Terms at any time. Updated terms become effective immediately upon posting to our website.
11.11 Governing Law
These gift card terms are governed by California law.
